Company vehicle: what to do if you've received a fixed penalty notice
We remind you that since 2017, article L121-6 of the French Highway Code stipulates that the legal representative of a company must designate the natural person who was driving the vehicle at the time of an offence, or be subject to a fine.

Don't pay the fine straight away! You must first designate the person who was driving the vehicle at the time the offence occurred. The person who has been designated will then receive a traffic violation notice in their own name and can pay the fine.

If the legal representative fails to designate the person who committed the offence, the legal entity risks a fixed fine of €675 for failing to designate the driver, an amount which can be reduced to €450 or increased to €1,875.

This requirement to designate the driver does not apply to those who are self-employed if their vehicle is registered in their name as a natural person and not that of their company as a legal entity (Court of Cassation ruling No. 530 of 21 April 2020).
